(1) No court shall take cognizance of any offence punishable under this Act or any rule or regulation or order made thereunder except upon a complaint in writing of the facts constituting such offence made by the planning
authority or by a person expressly authorised in this behalf by such planning authority within three months from the date of the commission of the offence:
Provided hat nothing contained in this sub-section shall affect the provisions of the Code of Criminal Procedure, 1898 (Central Act V of 1898), in regard to the power of certain Magistrates to take cognizance of offences upon information received or upon their own knowledge or suspicion.
(2) No Court inferior to that of a Presidency Magistrate or a Magistrate of first class shall try any offence punishable under this Act.
